Federal Court Blocks Proposed Merger of Aetna and Humana
The U.S. District Court for the District of Columbia yesterday prohibited two of the nation’s largest health insurers from merging, concluding that the proposed merger of Aetna and Humana was likely to substantially lessen competition for individual Medicare Advantage plans in all 364 counties challenged by the federal government in the antitrust case.

New FDA Draft Guidance On Medical Product Communications
The FDA released two separate draft guidances that will each help provide clarity for medical product companies on FDA's current thinking and recommendations for a few different types of communications about medical products.
 
The first draft guidance, "Drug and Device Manufacturer Communications with Payors, Formulary Committees, and Similar Entities", explains the FDA's current thinking and recommendations on firms' communication of healthcare economic information (HCEI) about approved drugs under section 502(a) of the FD&C Act, which was recently amended by the 21st Century Cures Act.
 
The second draft guidance, "Medical Product Communications That Are Consistent With the FDA-Required Labeling", explains the FDA's current thinking about firms' medical product communications that include data and information that are not contained in their products' FDA-required labeling, but that concern the approved or cleared uses of their products.

CMS Announces New Alternative Payment Model Participants
More than 359,000 clinicians have agreed to participate in four alternative payment models in 2017, the Centers for Medicare & Medicaid Services announced on January 18. The agency also released a request for applications from ACOs interested in joining the Next Generation ACO model in 2018.

DHS Issues National Cyber Incident Response Plan
On January 18, the Department of Homeland Security released a National Cyber Incident Response Plan to articulate the roles and responsibilities, capabilities and coordinating structures that support how the nation responds to and recovers from significant cyber incidents posing risks to critical infrastructure. The plan was developed in coordination with other federal agencies and public and private partners, including representatives from the healthcare and public health sector.

FDA Issues Safety Alert On Defibrillator
Physio-Control announced that the company is launching a voluntary field action for the LIFEPAK 1000 defibrillator due to reported instances where the device has shut down unexpectedly during patient treatment.
